This Privacy Policy is effective as of December 8, 2010.

The practices set forth in this Privacy Policy apply to the services available under the domain and subdomains of the www.famewizard.com web site (the “Site”), which is owned and operated by Fame Wizard, Inc., a California corporation, and its corporate affiliates (collectively, “us”, “we,” or “the Company”). By using the Site, you signify that you have read, understand and agree to be bound by this Privacy Policy (“Privacy Policy”).

The Company’s Privacy Policy (and any revisions thereto) is designed to help you understand how we collect and use the personal information you decide to share, and help you make informed decisions when using the Site. This Privacy Policy shall govern all information collected from or posted at the Site, and the use of the personal information you decide to share. We reserve the right, at our sole discretion, to change, modify, add or delete portions of this Privacy Policy at any time without further notice. If we do this, we will post the changes to this Privacy Policy on the Site and will indicate at the top of the page the Privacy Policy’s effective date. Your continued use of the Site after any such change constitutes your acceptance of the new Privacy Policy. If you do not agree to be bound by these or any revisions thereto, please do not use or access the Site. It is your responsibility to regularly review this Privacy Policy.

WHAT PERSONAL INFORMATION DO WE COLLECT?
You may browse portions of our Site and stream music without providing us with any personal information about yourself. However, in order to become a member of the Site (“Fan”), download music, purchase one of our product or service offerings, participate in one of our contests or surveys, or use other interactive features of the Site, you will need to provide us with your personal information, including without limitation your name, address, date of birth, email address and phone number, and your payment information, including your credit card number or payment account information. We may also collect demographic information that is not unique to you such as your ZIP code, musical preferences, gender, income level and interests. We may also collect information about the types, frequency and identity of music you stream and download, information you browse about bands listed on the Site and those of whom you become a fan, and your history of purchasing or using our products and/or services. Sometimes we collect or may collect a combination of these types of information.

USE/DISCLOSURE OF PERSONAL INFORMATION
The Company may use the information that you provide to fulfill your request for a download, a product, information, or other service, to process your entry into one of our contests or sweepstakes, or respond to an email or other request, as well as to create and deliver to you our newsletters or surveys, communications containing information about the Site, usage tips or promotions, help improve our website(s) or services, or customize visitors’ experience at our Site. The Company will also share your information with Fame Wizard Artists that you have indicated interest in, so that these Artists can communicate with you regarding their music, appearances, performances, etc. This means that even if you terminate your Fame Wizard account, these Artists may still contact you using your email address that was previously provided to them.

We want to communicate with you via email correspondence only if you want to hear from us. If for any reason you would no longer like to receive promotional or informational email messages from the Company or our Artists, you may remove yourself from our mailings by clicking on the “unsubscribe” link at the bottom of every email we send to you. Please allow up to 10 days for us to process your request. You may also opt out of receiving emails from particular Artists. Please note, if you opt not to receive marketing emails from the Company, you may still receive “Transactional” email messages regarding your downloads or other orders (i.e. order confirmation, shipping information, customer service notifications, etc.) If you have questions or concerns regarding this statement, please contact us at privacy@famewizard.com.

The Company may also share your email and/or mailing address with carefully selected vendors, business partners and other organizations whose products or services we think may interest you, if you select this option when you sign up to become a Fan. Many of our users find this a valuable and time-saving service. However, if you do not want us to share your personal information with third party organizations, you do not have to select this option when you sign up to become a Fan. You can always change your preferences later by clicking the “My Account” link on the Site.

We may also contract with companies or individuals to provide certain services including email and hosting services, credit card processing, shipping, data management, surveys and marketing, promotional services, etc. We call them our Service Providers. We may share personally identifiable information with Service Providers solely as appropriate for them to perform their functions, but they may not use such information for any other purpose. We do not share your credit card or other account information with unaffiliated third parties unless you authorize us to do so, or if it is necessary to fulfill our responsibilities including, but not limited to, delivering a product or service that you order.

Finally, the Company may disclose personal information in special cases: (1) when we have reason to believe that disclosing this information is necessary to identify, contact, or bring legal action against someone who may be causing injury to or interference with (either intentionally or unintentionally) the rights of the Company or to anyone that could be harmed by such activities; (2) when we believe in good faith that the law requires it; (3) to any third party who may acquire the Company; and (4) in situations involving threats to the physical safety of any person.

USE/DISCLOSURE OF NON-PERSONAL INFORMATION
The Company may also collect, store or accumulate certain non-personally identifiable information concerning your use of our Site, such as information regarding which of our pages or which Artist’s songs are most popular, your IP address, browser, city, time zone, and operating system. This information is not linked to your personal information. Information gathered may be used in aggregate form for internal business purposes, such as generating statistics, developing marketing plans, customizing content, and improving the Website. We may share or transfer such aggregate, non-personally identifiable information with or to our affiliates, licensees and partners.

POSTING TO PUBLIC AREAS OF THE SITE
Please remember that if you post any of your personal information in public areas of the Site, such as on your Fan page, Artists’ pages, online forums, blogs, message boards, or chat rooms, such information may be collected and used by others over whom we have no control. We are not responsible for the use made by third parties of information you post or otherwise make available in public areas of the Site.

PERMISSION TO USE YOUR CONTENT
By transmitting any information, identification, suggestions, material, or other content (collectively, “content’) via the Site or otherwise to the Company, you automatically grant the Company the royalty-free, perpetual, irrevocable, non-exclusive right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, redistribute, transmit, perform and display such content (in whole or part) worldwide and/or to incorporate it in other works in any form, media, or technology now known or later developed for the full term of any rights that may exist in such content. Further, the Company is free to use any ideas, concepts, know-how, techniques and suggestions contained in any communications you send to this Site for any purpose whatsoever, including but not limited to creating, manufacturing and marketing products and/or services using such information, all without compensation to you. The provisions of this paragraph shall continue to apply even if/when you are no longer a Fan.

ACCESS TO AND MODIFICATION OF YOUR INFORMATION
You may review, correct, update or change your Fame Wizard account information at any time by clicking on the “My Account” link on the Site homepage. We retain indefinitely all the information we gather about you in an effort to make your repeat use of the Site more efficient, practical, and relevant. Of course, you can delete your information from the Site, and close your Fame Wizard account at any time, in which event we will remove all our copies of your information from the Site, and remove your profile and account information, except for an archival copy which is not accessible on the Internet.

COOKIES
We use “cookies” to help create a better and more personalized experience. Cookies are alphanumeric identifiers that we transfer to your computer’s hard drive through your web browser to enable our systems to recognize your browser and to provide features. The Site uses persistent cookies to identify members after their first visit. These cookies remain on the hard drive of a personal computer and may allow a member to enter the site without having to log in on every visit. To access any secure areas such as your account information, you must still enter your password. You can choose to disable cookies by deselecting that option under your browser preferences. When you disable cookies, you may not be able to access all of the Site’s features. Disabling cookies can also interrupt audio and cause breaks in navigation. When becoming an approved user of the Site, you can choose whether or not to accept the Site’s persistent cookie.

THIRD PARTY ADVERTISING
Advertisements that appear on the Site are sometimes delivered (or “served”) directly to users by third party advertisers. They automatically receive your IP address when this happens. These third party advertisers may also download cookies to your computer, or use other technologies such as JavaScript and “web beacons” (also known as “1×1 gifs”) to measure the effectiveness of their ads and to personalize advertising content. Doing this allows the advertising network to recognize your computer each time they send you an advertisement in order to measure the effectiveness of their ads and to personalize advertising content. In this way, they may compile information about where individuals using your computer or browser saw their advertisements and determine which advertisements are clicked. Third party advertisers have no access to your contact information stored on the Site unless you choose to share it with them. This privacy policy covers the use of cookies by the Company and does not cover the use of cookies or other tracking technologies by any of its advertisers.

CHILDREN UNDER THE AGE OF 13
The Company does not knowingly collect or solicit personal information from anyone under the age of 13 or knowingly allow such persons to register on the Site. If you are under 13, please do not send any information about yourself to us, including your name, address, telephone number, or email address. No one under age 13 is allowed to provide any personal information to the Company. In the event that we learn that we have collected personal information from a child under age 13 we will delete that information as quickly as possible.

CHILDREN BETWEEN THE AGES OF 13 AND 18
The Company does recommend that minors over the age of 13 ask their parents for permission before purchasing, downloading or accessing any of the Company’s product offerings or Site content.

SECURITY
Although no use of the Internet is 100% secure, we work to protect the security of your information during transmission by using Secure Sockets Layer (SSL) software, which encrypts information you input. We use reasonable measures to protect user information that is stored within our database, and we restrict access to user information to those employees who need access to perform their job functions, such as our customer service personnel and technical staff. Please note that we cannot guarantee the security of user information. Unauthorized entry or use, hardware or software failure, and other factors may compromise the security of user information at any time.

CONTROL OF YOUR PASSWORD
You are responsible for all actions taken with your login information and password. Therefore we do not recommend that you disclose your Fame Wizard password or login information to any third parties. If you choose to share this information with third parties, you are responsible for all actions taken with your login information and password and therefore should review each third party’s privacy policy. If you lose control of your password, you may lose substantial control over your personally identifiable information and may be subject to legally binding actions taken on your behalf. Therefore, if your password has been compromised for any reason, you should immediately change your password.

YOUR CALIFORNIA PRIVACY RIGHTS
Under California Civil Code Section 1798.83, if you are a resident of California, you may request and obtain from us once a year, free of charge, information regarding our disclosure (if any) of your personal information to third parties for marketing purposes in the preceding calendar year.
